Four men on trial accused of murdering bouncer
Monday, 22 October 2007
Gary Campion, of Pineview Gardens, Moyross, Limerick; John and Desmond Dundon, both from Ballinacara Weston, Co Limerick, all in their 20s; and 50-year-old Clare businessman Anthony Kelly, with an address at Kilrush, deny murdering 34-year-old Brian Fitzgerald in November 2002 at his home on the Mill Road, Corbally, Limerick.
The court has heard that James Martin Cahill, who is the main witness for the State, will tell the jury that he pleaded guilty to shooting Mr Fitzgerald dead and is serving a sentence for it.
Denis Vaughan Buckely, for the DPP, said the four accused were also involved in planning the murder as part of a joint entreprise.
James Martin Cahill will say that Anthony Kelly contacted him about it, that he went to Dublin, where he was hired by a Mr A to kill Brian Fitzgerald.
He was told he would get €10,000 for it.
It is alleged Anthony Kelly provided him with the gun, showing him how to use it, that Dessie Dundon pointed out the victim, John Dundon showed him where to wait for the bouncer and Gary Campion drove the motor bike used on the night.
The court heard Cahill and Gary Campion lay in wait for the bouncer that night outside his home.
When he arrived, Cahill started to run at him, the vctim shouted at them and ran, but Cahill fired the gun a couple of times.
He went over to Mr Fitzgerald, who was lying face down, and shot him in the back of the head.
