Man wins court case over demolition of house
Friday, 17 July 2009
A documentary-maker whose house on Tory Island off Donegal disappeared after he left the island has won his case against the owner of the Tory Hotel.
Neville Presho left the six-bedroom house boarded up in 1986 and it was demolished without his knowledge in 1993.
He returned months later to find that the Tory Hotel was opened across the road and a car park was built where his house used to be.
The court heard that hotel owner, Patrick Doogan, asked a contractor to demolish the premises.
Today, Mr Justice Roderick Murphy dismissed Mr Doogan's claim that the house collapsed as a result of stormy conditions.
He directed that Mr Presho be given the value of a comparable home.
