A couple who sued the Health Service Executive over the stillbirth of their baby boy today settled their action at the High Court.
Lavinia Doyle and her Italian partner Luca Chiussi were seeking damages for wrongful death, citing the right to life of the unborn amendment to the Constitution.
They claimed they suffered severe emotional distress and sleeping difficulties following the stillbirth of their baby Ethan on July 25th 2003.
They claimed the HSE failed to detect or respond appropriately to the onset of constant abdominal pain.
The couple today settled their action for an undisclosed sum, and the HSE admitted liability in the case.
