Dublin youth has sexual assault convictions quashed

A Dublin youth has had two sexual assault convictions quashed because the Gardai failed to hold a formal identity parade.

The Court of Criminal Appeal freed 18 year old Eoin Dowling of Glenmore Park, Ballyboden after finding that the Gardai hadn't carried out the basic requirements for such a parade.

He was jailed for five years by the Circuit Criminal Court this year for two sexual assaults on a 14 year old girl, in the South Dublin suburbs in late 2003.

Today Mr Justice Adrian Hardiman said this was an important area of the law where there was an established record of miscarriages of justice due to wrongful identification.
