Lindsay Lohan 'was not drinking'

Lindsay Lohan was reportedly sober when she allegedly "clipped" a pedestrian in New York City Wednesday.

The 26-year-old actress was taken to jail Wednesday morning after being accused of hitting Manhattan chef Jose Rodriguez with her car and leaving the scene.

The victim in the accident told the New York Daily News that Lindsay "smelled like alcohol real bad" at the time of the incident.

Lindsay's father Michael discounts claims that the star was consuming alcohol.

"I am happy that she is away from other people and was NOT drinking last night!" Michael told Radar Online.

Lindsay was driving slowly in the alleyway between the Maritime and Dream hotels in NYC's Chelsea neighbourhood when she supposedly hit Jose.

TMZ reports she was "booked for leaving the scene of an accident" which is a misdemeanour offence. She was given a desk appearance ticket, which in New York is a document which orders a person to attend a criminal court for an arraignment. It meant she did not have to post bail.

Jose visited hospital and was given morphine for pain, but he did not sustain serious injuries.

There may be video security surveillance footage of the alleged crime that can either clear Lindsay's name or nail her.

Lindsay has been arrested several times before and earlier this year was named a person of interest in a jewellery theft. She was later ruled out of the case.
