Lindsay Lohan will not be prosecuted

Lindsay Lohan will not be charged with felony burglary.

The actress and her assistant Gavin Doyle became official suspects in a theft investigation after Sam Magid filed a report claiming over $100,000 worth of accessories were stolen from his Hollywood Hills home last week. Sam threw an all-night party that Lindsay and Gavin attended when his possessions went missing.

According to USA Today, the District Attorney's office will not pursue a case against the pair.

"We do not have sufficient evidence to prove this case beyond a reasonable doubt," a prosecutor wrote in a memo.

Lindsay is elated that a formal charge is completely off the table.

"Lindsay is glad this matter has been cleared up so she can focus on her upcoming projects," the star's representative Steve Honig released in a statement.

The 26-year-old star found herself in hot water last year when she breached the terms of her probation stemming from her no contest plea in a necklace theft case.

If she were charged with theft again Lindsay would have definitely gone to jail.

Lindsay was also involved in a car crash this year in which she wrecked a hired Porsche on the Pacific Coast Highway.
