Lohan avoids charges in assault case

Lindsay Lohan will not be charged for allegedly punching fellow partygoer Tiffany Mitchell at a New York City nightclub last year.

The 26-year-old actress was reportedly involved in an altercation with psychic Tiffany Mitchell in at trendy Avenue nightclub on November 29.

The 28-year-old fortune teller claimed the actress hit her with a closed fist in a dispute over space at a table.

The Manhattan District Attorney’s Office has decided not to prosecute the actress, the New York Daily News reports.

According to the newspaper witnesses failed to cooperate with investigators.

A surveillance camera also failed to capture any contact between the women.

The same camera apparently captured Tiffany falling over on her way out of the nightclub while being escorted by police on the night of the incident making it difficult to determine the cause of her injuries.

Lindsay denied hitting the alleged victim.

Tiffany’s attorney, Gloria Allred, confirmed the actress would not be prosecuted.

"Tiffany is very disappointed that the District Attorney has not decided to prosecute Lindsay Lohan as a result of the incident in New York," she stated.

The high-powered lawyer suggested a civil lawsuit may still be filed.

"Ms. Mitchell is considering all of her legal options in the civil justice system because of what she suffered that night," she continued.

Lindsay earlier this week struck a plea deal with Los Angeles prosecutors in a separate criminal case.

The actress agreed to enter a stay rehab facility for 90 days, complete 30 days of community labour and 18 months of psychiatric treatment after pleading no contest to charges of misdemeanour reckless driving and providing false information to police investigating her June car crash in Santa Monica.

Lindsay remains on probation from a 2011 jewellery theft case.
