The outlet claims that Morena filed papers asking for full custody of her one-year-old son Julius.

The reason for her requesting full custody is because her former husband Austin Chick lives in Los Angeles and she is in New York.

The actress has reportedly asked the judge to make a proactive order because there will soon come a time when her pregnancy will prevent her from flying.

The website also claims Morena is at the end of her first trimester.

Morena and Ben were first romantically linked back in July.

The pair met on the set of hit US TV show Gotham – a prequel to the Batman story. Ben has been playing Police Comissioner James Gordon on the show, while Morena joined the series at the end of the first season as Dr. Leslie Thompkins.

Ben has always been notoriously cagey about his love life. However, he has previously been romantically linked to The Vampire Diaries actress Nina Dobrev and Revenge star Emily VanCamp.

Previously admitting he likes to play his cards close to his chest when it comes to women, Ben told America’s Elle magazine: “I'm really shy about that stuff. I really don't like relationships to be played out in public. It creates terrible strain. It creates bizarre dynamics. There's that saying, "Less said about the bedroom, the better."'

Ben also revealed he likes to be a gentleman when it comes to dating. He added in the interview that getting a solid acting gig gave him the opportunity to take a girl out for a nice dinner – something he thinks is incredibly important.

“I like the idea of old-fashioned dating, which at this point is almost heretical,” Ben said. “People are genuinely surprised when you ask them out.”
