(Cover) - EN Showbiz - Sean Penn is suing Empire creator Lee Daniels for defamation.

In a recent interview with The Hollywood Reporter, Lee compared Sean to Terrence Howard, who stars in the hit US TV show.

Terrence has been accused of domestic violence on occasions in the past with many reports saying the actor has publicly admitted to several assaults.

"[Terrence] ain't done nothing different than Marlon Brando or Sean Penn, and all of a sudden he's some f***in' demon," Lee told The Hollywood Reporter. "That's a sign of the time, of race, of where we are right now in America."

Sean has hired former federal prosecutor Mathew Rosengart to represent him, with the lawyer filing a $10 million lawsuit in New York Supreme Court on Tuesday (22Sep15).

The documents state that the 55-year-old actor will not stand for defamatory comments being made about him in such a way.

“As a result of Penn's status as a public figure, he has for years been the subject of scandalous, scurrilous, and baseless attacks,” the first paragraph of the lawsuit reads. “But Penn, like any citizen, has a right to defend himself and will no longer tolerate the reckless and malicious behaviour of others, who seek to aggrandise themselves or their projects at his expense. Accordingly, and because of Daniels' defamatory statements, Penn brings this action for monetary relief, and to deter Daniels and others from their defamatory actions."

The lawsuit continues to say that Lee appears to be aware of Terrence’s reported assault guilt but still makes the comparison to Sean.

The actor continues to accuse Lee of having made the comments in a bid to promote Empire.

"Third, and most problematic, Daniels falsely equates Penn with Howard, even though, while he has certainly had several brushes with the law, Penn (unlike Howard) has never been arrested, much less convicted, for domestic violence, as his ex-wives (including Madonna) would confirm and attest,” the lawsuit concludes.

Lee has yet to reveal any statement about the lawsuit.
