Sofía Vergara thinks Nick Loeb is "creating something so ugly out of nothing" with their embryos case.

The former couple are currently embroiled in a case surrounding embryos they created in November 2013, not long before their split last May.

Sofía has since moved on and is now engaged to Joe Manganiello, but Nick is still insistent on getting a surrogate to carry the embryos and have children.

The Modern Family star has already spoken out against this idea and while her former beau insists it isn't personal, putting the cause down to "moral, legal, ethical concepts", the actress isn't having any of it.

"I really want to make this, like, the last time I talk about it. Because I don’t think it’s fair.

"I’ve been working very hard for 20 years to get to this point. I promote all my movies, all my work, but I don’t like promoting my private life and I don’t understand why this person... I don’t want to allow this person to take more advantage of my career and try to promote himself and get press for this," she explained on Good Morning America today.

She continued to note that Nick had agreed to abide documents signed years ago and that this case shouldn't be out there for people to talk about. With a court date lined up, Sofía doesn't understand how things have been so blown out of proportion.

"He shouldn’t be creating something so ugly out of nothing," she sighed.

"Just with the press, it’s like, and allowing somebody to invent things and create press for himself. He’s not an actor. He’s not a celebrity. It’s like, why?"

Overall Sofía isn't going to let her ex hold her back, putting things into perspective; she has an amazing career whereas he's got "nothing". She isn't sad about the situation and is instead planning her future with soon-to-be husband Joe.

During Nick's latest interview with the Today show he explained that the story was leaked to the press and insisted that he wouldn't mind if Sofía was to use the embryos to have kids with her new man.
