The 37-year-old mother-of-three was jailed on Friday after her husband was taken into custody for drink driving.
Police confirmed to Cover Media James Toth was booked at the Atlanta City Detention Center after he was pulled over in Atlanta, Georgia on suspicion of DUI.
Variety reports Reese was handcuffed at the scene after a verbal altercation with the arresting officer and repeatedly ignoring the officer’s request to stay inside the vehicle.
According to the publication the actress was arrested and booked on a charge of disorderly conduct.
The pair were released a few hours later.
A booking photo obtained by Cover Media shows Reese with a serene smile on her face. Her eyes are closed and hair parted down the middle. Jim’s eyes are slightly droopy and his expression vacant in the CAA agent’s own mugshot.
A police report obtained by Variety details how the actress allegedly resisted as her husband was put under arrest.
“Mrs. Witherspoon asked, ‘Do you know my name?’ I answered, ‘No, I don’t need to know your name.’ I then added, ‘right now.’ Mrs. Witherspoon stated, ‘You’re about to find out who I am,’” she is quoted as saying
“Mrs. Witherspoon also stated, ‘You are going to be on national news.’ I advised Mrs. Witherspoon that was fine,” the report continues.
Jim reportedly blew .139 on a Breathalyzer test at the scene. Georgia's legal blood alcohol content (BAC) limit is .08.
He faces a second charge of failure to maintain a lane while driving.
The couple have a court appearance scheduled for Monday morning at Atlanta Municipal Court.
It is believed their attorney will request that the date be postponed.
Reese has been in Atlanta filming civil war drama The Good Lie.
She attended the New York City premiere for her new film Mud on Sunday night. She looked upbeat as she posed for photographers in a black Yves Saint Laurent dress and black heels but declined to take any questions.
A spokesperson for the actress has yet to issue comment.
