Father of two charged with rape attack is refused bail
Tuesday, 21 August 2007
A 21-year-old father of two charged with raping a woman in Londonderry has been refused High Court bail after a judge was informed it took the PSNI two years to locate him.
Hughie McGinley was arrested in England last week and was brought back to
Derry charged with raping a woman in the city in July 2003. During
yesterday's hearing at Belfast's High Court, it emerged he is wanted for
questioning by the Gardai in connection with a rape in Sligo in November
2004.
McGinley, from King William Street in Stoke-on-Trent, denies
both allegations.
Crown lawyer David Reid said the PSNI in Derry
received a report from a 22-year old woman on July 6, 2003 claiming she had
been the victim of a sexual assault.
She was examined by police
and a DNA profile was taken from semen found on her. The profile was entered
into a national database but at the time, no matches were found.
Mr
Reid said that after being arrested in connection with a separate offence, a
DNA match was made to the profile from the alleged rape in Derry in July
2003.
Defence barrister Ivor McAteer said his client refuted both
accusations of rape.
Mr Justice Stephens voiced concerns McGinley
may not return for trial in Northern Ireland, and refused to release him on
bail.
