Man 'assaulted four-year-old in food row'

A man allegedly "lost the plot" and threw his ex-girlfriend's four-year-old brother onto a sofa for repeatedly going to a fridge seeking food, the High Court heard today.

Gary Kindelan is accused of an assault which resulted in the boy hitting his head on the furniture, prosecutors said.

It was also claimed he pushed his pregnant former partner around during a separate incident at her home in Limavady, Co Derry.

Kindelan, 19, of Argyle Street, Derry, faces charges of criminal damage, attempted criminal damage and three counts of common assault.

He was granted bail but banned from entering Limavady or contacting the alleged victims' family.

The alleged offences occurred on dates in January, February and March this year.

A prosecution barrister said police were told Kindelan became frustrated during an incident where the young boy was going in and out of the fridge to get something to eat.

"He is alleged to have lost his temper with the child, calling him names, and picked him up and thrown him onto the sofa where he hit his head," she said.

"The four-year-old child's sister, who was the applicant's girlfriend, alleged that he appeared to have lost the plot."

In a separate incident last month police were contacted over claims that Kindelan had arrived at the house and shoved the pregnant woman around.

She was said to have been distressed but made no official complaint.

Defence counsel Sean Doherty stressed the significance of the alleged victim not making a statement.

He added: "The applicant is clear that he would not endanger either the life of his partner or the unborn child."

Mr Justice Treacy granted bail for the accused to live with a relative in Strabane.

The judge also imposed a curfew and ordered him to contact his GP within 72 hours of being released. ends
