Uncle punched and bit nephew in row, court told

A mother shouted “he deserved it” at her son after he was bitten and beaten unconscious by his uncle because the teenager opted to spend New Year's Eve with his girlfriend rather than with them, a court has heard.

Steven Smith (22), from Bradley's Park in Londonderry, is charged with entering as a trespasser a house at St Eithne's Park and with inflicting grevious bodily harm on his 18-year-old nephew Dylan Smith.

Tracey Smith (37), from Glenview, is charged with entering the same house as a trespasser with intent to cause grievous bodily harm to her son.

Steven Smith has 33 previous convictions, while his sister has three.

A police detective told District Judge Barney McElholm that the defendants are alleged to have gone to the victim's girlfriend's house in the early hours of New Year's Day.

“Dylan Smith and independent witnesses have said that Tracey and Steven Smith got into an argument with him over why he'd refused to spend New Year's Eve with them and gone to his girlfriend's family home instead,” the officer told Derry Magistrates Court.

“They say that Steven Smith attacked Dylan, punched him, bit him and headbutted him, knocking him unconscious.

“They say that Tracey Smith made no attempt to stop the attack on her son and when it was over she stood over him as he lay unconscious on the kitchen floor and said ‘he deserved it'.

“The injured party was later treated in hospital for bite lacerations to his ear and cheek and we believe that alcohol and drugs played a part in the defendants' actions,” the officer added.

The police witness said she was objecting to the defendants being released on bail because of the risk of witnesses being interfered with and because of both defendants' criminal records.

Describing the allegations as “disgraceful and brutal”, the District Judge refused bail and remanded the brother and sister in custody until January 26.
