Rape accused claims sex consensual

A man charged with raping a woman as his girlfriend slept in the same bed claimed they were involved in a threesome, the High Court has heard.

The 36-year-old suspect, who cannot be named for legal reasons, is accused of carrying out the attack after a night out in Tyrone.

A judge was told that the alleged victim woke in the early hours of July 3 to find him trying to have sex with her.

Prosecutors said the woman had been out drinking with the accused and his girlfriend - her work colleague - and then returned to their house.

It was alleged that after she woke and was about to leave in a distressed state the man told her: "You were asking for it."

The accused, who is non-European, was arrested with two different passports on his possession, the court heard.

Bail was granted but Mr Justice McCloskey also ordered him to live at an agreed address and report daily to police.
