A judge has refused to dismiss charges against a former Ohio hospital worker accused of encouraging supporters of the Islamic State terror group to behead US military members.

Judge Dan Polster threw out a motion to dismiss 15 terror-related charges against Terrence McNeil in Cleveland federal court.

Defence lawyers had argued that the indictment against McNeil, 26, was not based on facts.

The FBI says McNeil, of Akron, posted a file on his Tumblr page in September 2015 containing the names and addresses of military members, then urged IS supporters to behead those mentioned.

Court filings indicate that McNeil intends to waive his right to a jury trial and have his case decided by Judge Polster.
