Estate agent’s inaccuracy leads to fine under descriptions act

A Co Armagh estate agent was fined in court yesterday for wrongly stating properties would be finished with a pink pebble driveway.

Williams Estate Agents was convicted of one charge brought under the Property Misdescriptions Act 1991 and fined £300 at Craigavon Magistrates Court over the description of the houses at Toberhewney Lodge in Lurgan.

The business was also acquitted on another similar charge.

The case was brought by the Trading Standards Service of the Department of Enterprise, Trade and Investment. The department said an investigation in October 2008 revealed the estate agent had ‘misdescribed’ the new properties as being finished with ‘pink pebble driveways’, when the driveways were to be left unfinished.

A DETI spokesman said Craigavon Magistrates Court heard evidence that the misdescription was contained in brochures produced by Williams.

The spokesman said the estate agent “persisted in marketing the houses on the new development with misleading information” despite receiving a complaint from a purchaser. Richard Knipe, of the Trading Standards Service, said: “With the current market conditions it is imperative that all those involved in the sale of houses tell the truth about all aspects of the property.”
