Apology of Derry ear-biter is read out in court
A man has apologised for biting off part of the left ear of a man he attacked in Londonderry more than three years ago.
Brian Maxwell (31) admitted committing the offence against a 22-year-old man at Dunluce Court on May 23, 2010.
Initially Maxwell, from Fern Park, had denied causing grievous bodily harm with intent.
But when he was rearraigned before Judge Philip Babington at the Crown Court yesterday, he pleaded guilty to the lesser offence of causing grievous bodily harm. His guilty plea was accepted by the prosecution.
Maxwell's victim was in court to hear defence barrister Joe Brolly apologise on his client's behalf. Mr Brolly said Maxwell, who is under the care of the community mental health team, had already apologised to his victim and wanted that apology, which has been accepted, to be made public.
Judge Babington said while he accepted the apology was genuine, assaults involving biting had become too common. He ordered the preparation of pre-sentence reports before he sentences Maxwell early in the new year.
