Four-month sentence for lewd act on Belfast-bound Enterprise train
A man who fondled himself on the Enterprise train in a carriage where three children were present has been handed a four-month prison sentence.
Belfast Crown Court heard that David Bryan Douglas (57), from Dufferin Avenue in Bangor, had a criminal record for similar offences.
Crown prosecutor Philip Henry said the incident occurred on the Belfast-bound Enterprise train on February 23 this year, when a woman told a member of staff a man was rubbing his groin underneath his trousers. Three children were present as Douglas masturbated on the train, but they didn't see him carrying out the lewd act.
When the train arrived at Central Station in Belfast, Douglas was arrested. He told officers he had drunk two bottles of wine and some beer and had no recollection of the incident, but he subsequently pleaded guilty to committing an act outraging public decency by behaving indecently on the train.
A defence barrister said that while her client couldn't remember the offence, he "didn't deny it".
Telling the court there "seems to be pattern of offending emerging", the barrister said the children on the train "were not aware of his behaviour".
Sentencing Douglas, Belfast Recorder Judge David McFarland told him that while he accepted there was no contact with anyone, the offence was a "serious matter, not least because of your criminal record, as you have convictions for similar behaviour".
