Judge's warning to lawyer
A district Judge yesterday advised solicitors that they should not take withdrawal statements from people who have made allegations against defendants represented by the same solicitors.
Judge Barney McElholm made the comment at the Magistrate's Court in Londonderry when he was told that complainants in an assault case had made statements withdrawing their allegations to the defendant's solicitor.
A lawyer representing legal firm JB Stelfox and Co confirmed that withdrawal statements had been made to his instructing solicitor.
Mr McElholm described the practice as “very dangerous” and said defence solicitors should not even be talking to complainants.
“They should not let them inside the door of their offices,” he said.
