Dublin 'must take part in border poll court action'

The Irish Government is "constitutionally bound" to take part in a High Court case on the holding of a border poll in Northern Ireland, it has been claimed.

Lawyers for victims' campaigner Raymond McCord challenging the circumstances for a referendum claimed the Good Friday Agreement imposes a legal duty on the Dublin administration.

Mr McCord is seeking to judicially review the British Government's alleged failure to implement a policy for going to the public on the constitutional issue.

The case is set for a hearing in Belfast later this month.

Mr McCord's legal team had invited the Irish Government to become a notice party in proceedings, but his solicitor Ciaran O'Hare revealed the offer has not been taken up.

The case against the Secretary of State for Northern Ireland James Brokenshire questions the legality and transparency of current provisions for holding a border poll.
