MPs would vote on Paisley's Commons suspension if he resigns to force by-election

MPs would decide if Ian Paisley's suspension would be carried over it he resigned to force a by-election.

The North Antrim MP is facing a 30-day suspension from the House of Commons after failing to declare two luxury holidays paid for by the Sri Lankan government.

He has also been suspended by the DUP pending an internal investigation.

A petition of recall has been set up in North Antrim and if 10% of the electorate sign the petition a by-election will be held in the constituency.

The petition, which is due to run until September 19, is the first of its kind in UK parliamentary history.

On Wednesday The Belfast Telegraph revealed Mr Paisley could resign, forcing an early by-election, possibly allowing him to return to the Commons early.

If he were to win the by-election as expected, Mr Paisley would only be missing from the chamber for just over a week as Parliament rises for the party conference season on September 13, and doesn't return until October 9.

However, a source close to Mr Paisley has denied that he is planning to resign and the DUP has declined to comment on the speculation.

A House of Commons spokesperson said that though "the suspension would not automatically carry over" in the event of a by election, if Mr Paisley is re-elected it would be up to the House of Commons to decide if he would still have to serve the suspension.

"It would be up to the House, presumably following a recommendation from the Standards Committee, to decide whether to re-impose any unserved term," the spokesperson said.

If the suspension goes ahead as planned Mr Paisley would miss key Brexit votes scheduled for October and November.

His suspension is also a blow to the minority government of Prime Minister Theresa May who relies on the support of DUP MPs to pass legislation.
